Please read these Terms of Service ("Terms") carefully before using the Nutrient mobile application operated by Thriv Studios ("we", "us", or "our"). By downloading or using Nutrient, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Nutrient, you confirm that you are at least 16 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not use the app.

2. Description of Service

Nutrient is an AI-powered nutrition tracking application that provides calorie tracking, meal logging, AI meal planning, food photo scanning, macro tracking, and related health features. The app is available on iOS via the Apple App Store.

3. User Accounts

Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Subscriptions and Billing

Nutrient offers a free tier and a Premium subscription. Premium subscriptions are billed through Apple's In-App Purchase system. By subscribing to Premium, you agree to the subscription terms and authorize recurring charges to your Apple ID.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage or cancel your subscription in your Apple ID account settings
  • No refunds are provided for partial subscription periods, except as required by applicable law

5. Not Medical Advice

Nutrient is not a medical application and does not provide medical advice. Nutritional information, AI recommendations, and meal plans are for informational purposes only and should not replace professional medical or dietary advice. Always consult a qualified healthcare provider before making significant changes to your diet, especially if you have a medical condition.

6. User Conduct

You agree not to:

  • Use the app for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or tamper with the app
  • Scrape, copy, or redistribute our content or AI outputs
  • Impersonate any person or entity
  • Use automated tools to access the app or its APIs

7. Intellectual Property

All content in Nutrient (including the app design, graphics, AI models, and branding) is owned by Thriv Studios or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

8. Third-Party Services

Nutrient integrates with third-party services including Apple HealthKit, Apple Watch, and AI providers. Your use of these integrations is also governed by the respective third parties' terms of service.

9. Disclaimer of Warranties

Nutrient is provided "as is" without warranties of any kind. We do not warrant that the app will be uninterrupted, error-free, or completely accurate. Nutritional data is sourced from public databases and AI models and may not be 100% accurate in all cases.

10. Limitation of Liability

To the maximum extent permitted by law, Thriv Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Nutrient, even if we have been advised of the possibility of such damages.

11. Termination

We reserve the right to suspend or terminate your access to Nutrient at any time for violation of these Terms. You may stop using the app at any time. Upon termination, your right to use the app ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of Nutrient after changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of Nutrient shall be resolved through binding arbitration or in the courts of competent jurisdiction.
